16. RESPA / Affiliated Business Arrangement Disclosure

Clients who work with Jorge Villanueva in a real estate transaction may also be offered mortgage loan origination services by Jorge Villanueva in their capacity as a licensed loan originator. This dual-role relationship constitutes an Affiliated Business Arrangement ("AfBA") under the Real Estate Settlement Procedures Act ("RESPA"), 12 U.S.C. § 2607.
You are NOT required to use Jorge Villanueva's mortgage loan origination services as a condition of your real estate transaction. You are free to shop for and select any provider of settlement services you choose. 17. Arbitration & Class Action Waiver
Dispute Resolution — Binding Arbitration & Class Action Waiver
Please read this section carefully. It affects your legal rights.
Informal Resolution First. Before initiating any formal dispute, you agree to contact Company in writing and provide a detailed description of the dispute and your desired resolution. The parties agree to attempt to resolve the dispute informally for a period of thirty (30) days from the date of written notice.
Binding Arbitration. If the dispute cannot be resolved informally, you and Company agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any services offered — including disputes regarding the validity, enforceability, or scope of this arbitration clause — shall be resolved by final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court.
* Arbitration shall take place in Maricopa County, Arizona, or via remote hearing.
* The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
* The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the interpretation and enforcement of this arbitration agreement.
Class Action Waiver. YOU AND COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
Exceptions. Either party may seek emergency injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm, without waiving the right to arbitrate the underlying dispute.
California Residents. Notwithstanding the above, California residents retain rights under California law that may limit the enforceability of certain arbitration provisions. Nothing in this clause is intended to waive any rights that cannot be waived under California law.
18. No Guarantee of Loan Approval
No Loan Commitment or Guarantee
Nothing contained on this Site, including but not limited to any rate quote, loan program description, mortgage calculator result, or pre-qualification estimate, constitutes a loan commitment, conditional approval, pre-approval, or guarantee of financing of any kind.
All mortgage loan applications are subject to:
* Full underwriting review and credit approval;
* Verification and documentation of income, assets, employment, and identity;
* Satisfactory property appraisal and title review;

19. Severability
If any provision of these Terms is found by a court of competent jurisdiction or arbitrator to be unlawful, void, invalid, or unenforceable for any reason, that provision shall be deemed severed from these Terms to the minimum extent necessary and shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect. Any invalid provision shall be modified to the minimum degree necessary to make it enforceable, consistent with the original intent of the parties.

22. Entire Agreement
